Local Ordinances
Noise Nuisances
A. No person shall make, cause, suffer,
allow or permit to be made within Perry Township, Stark County, Ohio any
unreasonably loud, disturbing and unnecessary noise or noises of such character,
intensity or duration as be detrimental to the life, health and right to peace
and enjoyment of any individual.
Loud, disturbing and unnecessary noises in
violation of this section shall include, but are not limited to, the following:
- The sounding of any horn, bell or other
signal or warning device on any motor vehicle, except as a danger or warning
signal.
- The harboring or keeping of any dog or
animal which, by causing frequent or long continued noise disturbs the
peace, enjoyment, comfort and repose of any person in the vicinity, where
such noise can be heard outside the property line of the premises at which
the dog or animal is kept. Any persons who shall allow any dog or animal to
remain, be lodged or fed within any dwelling, building, yard or enclosure,
which he occupies or owns, shall be considered as harboring such dog or
animal. None of the provisions of this resolution applies to licensed
veterinary hospitals, owners, operators or employees of duly licensed
kennels or animal boarding establishments and blind persons when a dog
serves as a guide or leader.
- (A) No person shall play any music,
amplifying sound, radio music player, television, audio system or musical
instrument in such a manner or at such a volume as to annoy or disturb the
peace and quiet, comfort or repose of neighboring inhabitants or to those
who said noise is audible more than 100 feet of said sound source having due
regard for the proximity of places of residence, hospitals or other
residential institutions and to any other conditions affected by such noises
or at a volume which is audible within 100 feet of said sound source.
(B) On a street, highway or in a public
right of way where the sound is audible 100 feet from the device generating
the sound.
- The making of any unnecessary or
unseemly noise by a person or by his operation of any instrument, device,
agency or vehicle within 80 feet of any portion of the grounds and premises
on which is located a hospital or other institution reserved for the sick,
aged, or infirm, or within 80 feet of any school, courthouse, church or
building in which religious services are held during school hours, hours of
court or hours of public worship respectively.
- Whoever violates this resolution is
subject to a fine of $50.00 for the first violation a fine of $100.00
for the second violation and $250.00 for each subsequent violation.
Curfew For Persons
Under Eighteen Years Of Age
(A) Definitions: As applicable to the
curfew for persons under eighteen years of age within any of the unincorporated
areas of the township, the following definitions shall apply:
- "Minor" means any person
under eighteen years of age;
- "Parent" means the natural or
adoptive parent of a minor;
- "Guardian" means any person
other that a parent who has legal guardianship of a minor;
- "Custodian" means any person
eighteen years of age or older who is in-loco-parentis to a minor.
- "Public Place" means any
alley, street, road, highway, or right of way, including sidewalks, parks,
playgrounds, grounds, place, building or lands open to the public; any
privately or publicly-owned place of amusement, entertainment, or public
accommodation, to include any parking lot and other common areas or public
areas adjacent thereto; and any vacant lot or land, or, any private property
without the consent of the owner of said private property.
(B) The curfew for minors and persons
under eighteen years of age:
- No minor shall loiter, idle, wander,
stroll, play, be within or upon any vehicle or be at , in or upon any public
place within the unincorporated areas of Perry Township, Stark County, Ohio,
between the hours of 12:00 p.m. (midnight) and 6:00 a.m., Sunday night
through Thursday night.
- No minor shall loiter, idle, wander,
stroll, play, be within or upon any vehicle or be at , in or upon any public
place within the unincorporated areas of Perry Township, Stark County, Ohio,
between the hours of 12:30 a.m. and 6:00 a.m. Friday night through Saturday
night.
(C) Provided that the provisions of this
Resolution shall not apply to the following:
- To a minor accompanied by a parent,
guardian, custodian having legal or actual custody or control of such minor;
- To a minor who is on an emergency
errand or specific business or activity directed, permitted or instructed by
his parent, guardian, or custodian having the legal or actual care and
custody of said minor;
- To a minor who's presence is connected
with or required by some legitimate employment, trade, profession, or
occupation;
- To a minor attending or returning
within one hour after the conclusion thereof, from any scheduled activity by
any school board of education or from any other special functions scheduled
by any other church, school, civic or charitable organization.
BE IT FURTHER RESOLVED by the Board of
Trustees for Perry Township, Stark county, Ohio, that the Perry Township Police
Department, the Stark County Sheriff's Department, the Ohio State Highway
Patrol, or any other duly authorized police or law enforcement agency are
authorized to enforce this Resolution and, pursuant to Ohio Revised Code Section
505.89 (B), any person under eighteen years of age who violates this curfew
shall be charged as being an unruly child and taken before the Juvenile Court as
provided in Chapter 2151 of the Ohio Revised Code.
No Parking -
Unhitched or Unattended Trailer
No trailer, not hitched to a
licensed, towing, motor vehicle, shall be left parked or unattended within the
traveled portion of any road within Perry Township, Stark County, Ohio.
Any trailer in violation of
this resolution and that creates a hazard or danger to the motoring public shall
be towed at the owner's expense.
Whoever violates this
Resolution shall be subject to the citation and penalties as set forth in O.R.C.
504.05, or $50.00 for the First Offense, $100.00 for the Second Offense, and
$250.00 for each Successive Offense.
Perry Township Parks
On September 15, 1998 the Board of
Trustees amended the park rules so that the parks would be closed from sunset to
sunrise, from Labor Day to Memorial Day.
